Terms of Service

1.Acceptance of Terms

By accessing or using the Service — including creating an account, starting a practice session, playing a learning game, or purchasing a subscription — you accept these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you are under 18, a parent or legal guardian must review and accept these Terms on your behalf.

2.Eligibility & Parental Consent

The Service is designed for students in grades 3–8 preparing for the New York State Tests and the NYC Specialized High Schools Admissions Test (SHSAT), and for their parents and guardians.

• Students under 13: a parent or legal guardian must provide consent before the account is created. By creating or approving an account for a child under 13, the parent or guardian represents that they have reviewed these Terms and the Privacy Policy and consent to the limited collection of the child's information as described there, in accordance with the Children's Online Privacy Protection Act (COPPA).
• Students 13–17: may use the Service only with a parent or guardian's permission.
• Parents and guardians are responsible for supervising their child's use of the Service.

3.Description of the Service

AceMyStates provides digital test preparation, including: adaptive practice questions; full-length computer-based exam simulations for the SHSAT and NY State Tests; AI-generated practice questions and essay feedback; flashcards and vocabulary tools; progress tracking and predicted-score estimates; educational arcade games; and optional weekly progress emails to parents.

4.Accounts & Security

You must provide accurate and complete information when creating an account and keep it up to date. Sign-in uses one-time email codes; you are responsible for maintaining control of the email address on the account. Each account is for one student. Sharing, selling, or transferring accounts is not permitted. Notify us at acemystates@gmail.com if you suspect unauthorized use of your account.

5.Subscriptions, Billing & Cancellation

• Plans. The Service offers a free tier and paid subscription tiers (currently "Core" and "Max"), billed monthly or annually.
• Payment processing. All payments are processed by Stripe, Inc. Your card details go directly to Stripe's PCI-DSS certified systems; we never see or store full card numbers. Purchases are also subject to Stripe's terms.
• Auto-renewal. Paid subscriptions renew automatically at the end of each billing period until cancelled. By subscribing you authorize recurring charges to your payment method at the price and frequency shown at checkout.
• Cancellation. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. We do not charge cancellation fees.
• Price changes. We may change subscription prices with at least 30 days' notice. Changes apply from your next renewal after the notice period.
• Taxes. Prices may be exclusive of applicable taxes, which are calculated at checkout where required.

6.Refunds

If something went wrong — a duplicate charge, a billing error, or a service problem — email acemystates@gmail.com within 14 days of the charge and we will make it right. Other refund requests are reviewed case by case in good faith. Nothing in this section limits any non-waivable rights you have under applicable consumer-protection law.

7.Virtual Items (Coins, XP & Rewards)

The Service includes virtual currencies and items — such as coins, XP, streaks, avatar items, and in-game gold — earned through practice and play.

• Virtual items have no monetary value, are not redeemable for cash or anything of value outside the Service, and cannot be sold, traded, or transferred.
• Virtual items are a limited, revocable license to use a feature of the Service, not property.
• We may adjust, rebalance, or reset virtual-item balances to fix bugs, prevent abuse, or maintain fair play.

8.Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service, other users' accounts, or related systems; (c) reverse-engineer, decompile, or copy any part of the Service; (d) use bots, scripts, or scrapers to access the Service or farm rewards; (e) resell or redistribute Service content commercially; (f) upload or submit unlawful, hateful, or harassing content; (g) harass or harm other users; (h) misrepresent your identity or grade level; or (i) interfere with the operation or security of the Service.

9.Fair Play & Leaderboards

Leaderboards, weekly leagues, and competitions are meant to be fun and fair. Manipulating scores, coins, rankings, or streaks — including through multiple accounts, automation, or exploiting bugs — is prohibited. We may remove scores, reset balances, or suspend accounts involved in manipulation. Leaderboards display only the player's chosen display name, never an email address.

10.Intellectual Property

The Service — including its code, design, artwork, characters, question content, text, and logos — is owned by or licensed to AceMyStates and protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes. SHSAT and New York State Test names are used to describe what the Service prepares students for; AceMyStates is not affiliated with, or endorsed by, the NYC Department of Education or the New York State Education Department.

11.Your Content

Content you submit to the Service — such as essays submitted for AI feedback or a display name — remains yours. You grant us a limited license to process and store that content solely to operate and improve the Service (for example, to grade an essay and show you the feedback). You are responsible for what you submit.

12.AI-Generated Content

Parts of the Service — practice questions, explanations, and essay feedback — are generated by artificial intelligence. AI content can contain mistakes. It is provided for educational practice only and should not be treated as authoritative or error-free. If you spot an incorrect question or explanation, we would genuinely like to hear about it at acemystates@gmail.com.

13.Third-Party Services

The Service relies on third-party providers: Stripe (payments), Supabase (database and authentication), DeepSeek (AI content generation), Resend (email delivery), and Vercel (hosting). Their availability and practices are governed by their own terms and policies, and we are not responsible for interruptions caused by their infrastructure. 14.Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE.

15.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACEMYSTATES AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.

16.Indemnification

You agree to indemnify and hold harmless AceMyStates, its operators, and agents from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service. This section does not apply where prohibited by law.

17.Termination

You may stop using the Service, or request account deletion, at any time. We may suspend or terminate accounts that violate these Terms or harm the Service or other users; where reasonable, we will warn you first. Sections that by their nature should survive termination (including Sections 10, 14–16, and 19) survive.

18.Changes to These Terms

We may update these Terms from time to time. For material changes we will give notice — by email or a prominent notice in the Service — before the changes take effect. The "Last updated" date above always reflects the current version. Continued use of the Service after changes take effect constitutes acceptance.

19.Governing Law & Disputes

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Disputes shall be resolved in the state or federal courts located in New York County, New York, and the parties consent to their jurisdiction. Before filing any claim, please contact us — most issues can be resolved quickly and informally.

20.General Provisions

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the rest remains in effect.
• No waiver. Our not enforcing a provision is not a waiver of it.
• Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the Service.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
